Traffic offenses including DUI/DWI are not expungable. They are traffic offenses, not criminal offenses in the State of New Jersey.

Even if your charges were dismissed, you may have an arrest record which you may want to expunge.

The Expungement Process

You begin the expungement process by obtaining a copy of your criminal history. The quickest and easiest way to schedule your appointment to be fingerprinted is via the Web at www.bioapplicant.com/nj. Web scheduling is available 24 hours per day, seven days per week.  The fee for this service is $40.70, the form A can be found at http://www.njsp.org/criminal-history-records/index.shtml

If you need a background check within the state of New Jersey but are no longer a resident, please call the Division of State Police, Criminal Information Unit, (609) 882-2000 Ext. 2918. The State Police will supply you with a package, including a fingerprint card and full instructions.

Once you have received a copy of your New Jersey criminal history, please fax (609) 261-0686 or email Deana@Sitzlerlaw.com a copy of your criminal history for an attorney to look over to determine if you are eligible and what type of expungement you should file and the fee amount.

Types of Expungement:

  • Early Pathways
  • Disorderly Person Offenses
  • Arrests not resulting in conviction
  • Indictable offenses a.k.a Felony Offenses

Your signed Petition for Expungement, Order for Hearing, and Order for Expungement and the filing fee of $75 will be submitted to the Superior Court for filing. Once the Hearing date is received, all necessary parties will be notified. A copy will be forwarded to you.

Ordinarily, you will not be required to appear at the hearing date. A copy of the Order for Expungement will be forwarded to you upon receipt. The Order will also be forwarded to the top employment background-check companies to have any records they may have be removed.

This process takes approximately six months.
