Criminal Homicide 2C:11-2

Criminal Homicide in the State of New Jersey is defined as follows: a person is guilty of criminal homicide if they purposely, knowingly, recklessly or under the circumstances set forth in section 2C:11-5 (death by auto), cause the death of another human being.  Criminal Homicide is murder, manslaughter, or death by Auto.

Murder 2C:11-3

Murder is defined as follows: when the actor purposely and knowingly causes death or serious bodily injury resulting in death; or when the is engaged in the commission of, or an attempt to commit, robbery, sexual assault, arson, burglary, kidnapping, carjacking, criminal escape or terrorism.

 Manslaughter 2C:11-4

 Criminal homicide constitutes aggravated manslaughter when the actor causes death under circumstances manifesting extreme indifference to human life; or the act is committed recklessly.  Manslaughter is a crime of the second degree.

Death by Auto or Vessel 2C:11-5

Criminal homicide constitutes vehicular homicide when it is caused by driving a vehicle or vessel recklessy.

 A car accident that results in a death is tragic for everyone involved. If a driver involved in the accident is taken to the hospital, he or she will undergo an automatic blood test. If the person's blood alcohol concentration (BAC) is .08 or higher, the prosecution will probably charge the driver with the highest crime possible. If the driver was not drinking, but was traveling 100 mph, that too could result in a serious charge such as Death by Auto.
